Terms of Service

By accessing or using the website at https://buildforuser.com, engaging our engineering services, or signing in to our client dashboard, you ("Client", "User", "you") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all terms, you must not access or use our services.

If you are accepting these Terms on behalf of a company, partnership, or other legal entity, you represent and warrant that you have full legal authority to bind that organization.

BuildForUser operates as a dual technology studio providing both bespoke digital engineering and software services:

BuildForUser Pre-existing IP: BuildForUser retains ownership of its proprietary agency core software, including our central dashboard platform, custom in-house automation engines, and underlying SaaS orchestration libraries. Clients receive a worldwide, non-exclusive license to use these tools during their active engagement.

Our platform allows you to connect third-party APIs (such as Google Search Console, Google Analytics 4, OpenPageRank, OpenAI, or payment processors). By connecting these accounts:

• You represent that you have authorized administrative or delegate rights to grant BuildForUser read or write access to those accounts.
• You acknowledge that BuildForUser operates under the respective third party’s developer terms (e.g. Google API Services User Data Policy).
• You can disconnect any integration at any time through your dashboard settings, which permanently stops data syncs and deletes associated authorization credentials.

You agree not to misuse our website or client platform. Specifically, you will not:

• Use the services to publish, transmit, or distribute unlawful, fraudulent, defamatory, or harmful content.
• Attempt to reverse engineer, decompile, or compromise the security of our central agency infrastructure.
• Conduct unauthorized automated load testing, denial-of-service attempts, or vulnerability scans without prior written agreement.
• Share administrative portal login credentials with unauthorized third parties.

Project fees, retainers, and subscription charges are specified in your written statement of work (SOW), project quote, or client dashboard tier.

• Invoicing: Project milestones are invoiced according to agreed delivery phases. Payment is due upon receipt unless agreed otherwise in writing.
• Monthly Growth & Retainer Plans: Subscriptions renew automatically at the beginning of each billing cycle unless cancelled with 30 days notice.
• Taxes: All quoted prices exclude applicable local sales taxes, VAT, or withholding taxes unless explicitly indicated.

We engineer our websites according to industry best practices, modern security standards, and high performance benchmarks (Core Web Vitals 90+). However, except as explicitly provided in a separate Master Services Agreement:

THE SERVICES AND PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC SEARCH ENGINE RANKINGS OR ZERO DOWNTIME CAUSED BY THIRD-PARTY CLOUD OUTAGES.

To the maximum extent permitted by applicable law, BuildForUser and its contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising from your use or inability to use our services.

Our aggregate total liability for any claims arising under these Terms shall not exceed the total fees actually paid by you to BuildForUser in the three (3) months preceding the incident giving rise to liability.
